A fourth offence of driving under suspension may still attract a suspended sentence of imprisonment rather than immediate imprisonment where the driving occurred in circumstances of genuine emergency, such as searching for a missing child with a history of serious behavioural problems. An order calling in a prior suspended sentence may be set aside as unjust where the breach offence was committed in such extenuating circumstances.
