Evidence of possession of small quantities of drugs of different composition from the drugs charged, together with drug dealing paraphernalia, is admissible on charges of possession with intent to sell or supply as tending to show the accused was dealing in drugs. Proof of custody or control with guilty knowledge is prima facie sufficient to establish the mental element of possession under the Misuse of Drugs Act 1981 (WA). A subsequent reduction of an earlier sentence on appeal does not constitute an exceptional circumstance justifying an extension of time to appeal a later cumulative sentence.
