'Circumstances of the accident' under s 45(1)(a) of the Motor Accident Insurance Act 1994 (Qld) encompasses all events causative of the accident, including the degree of intoxication of the driver or passengers from drugs or alcohol, and is not limited to events contemporaneous with the collision. The insurer's power to seek information under s 45 is not confined to requests for 'particulars' and may extend to interrogatory-style questions. However, where a claimant has substantially and reasonably answered the questions posed, the court will not order further answers.
