Where a jury convicts of possession with intent to sell or supply after being directed that the Crown must prove intent to sell or supply 'any part' of the substance, the sentencing judge must independently determine beyond reasonable doubt the quantity intended for distribution, and cannot treat the verdict as establishing that the entire quantity was for sale or supply. Failure to make such a finding will result in the sentence being quashed.
