Where a co-offender's sentence has been reduced on appeal on an erroneous basis (including where the reduction was itself based on parity with a third co-offender who was erroneously sentenced too leniently), a further co-offender seeking parity with the reduced sentence may be refused relief on the ground that the proposed reduction would compound the error and constitute an affront to the proper administration of justice. The Court is not bound by Crown concessions on sentence and will not follow an erroneous decision of a differently constituted bench merely for the sake of consistency.
