A person required to remain at a breath-testing location under s.55(1) of the Road Safety Act 1986 (Vic) does not commit the offence of refusal under s.49(1)(e) merely by temporarily stepping outside the physical confines of the testing vehicle or station, provided they remain in close proximity and available for testing. The offence requires proof of an unwillingness to comply with the requirement to remain for the purpose of the test, not merely a temporary physical departure. The word 'place' in s.55(1) encompasses the immediate vicinity of the designated testing location.
