The defence of 'reason of a substantial character' in s.55(9) of the Road Safety Act 1986 (Vic) is confined to a charge of refusing to furnish a sample of breath for analysis and does not apply to a charge of refusing to accompany a police officer to a police station under s.55(1). Section 55(1) creates at least two (and possibly four) separate requirements, each capable of founding a separate charge under s.49(1)(e).
