A wholly suspended sentence for digital rape will be manifestly inadequate absent truly exceptional circumstances. Generally speaking, digital rape should result in an immediate custodial sentence of substantial duration, and there will be very few crimes of rape, digital or otherwise, that warrant a non-custodial sentence. Aggravating circumstances including the victim being in her own home and bed, persistence of the attack, and grave consequences for the victim will weigh heavily against total suspension, even where substantial mitigating factors exist.
