The statutory power under s 20(1)(a) of the Town Planning and Development Act 1928 (WA) to approve subdivision subject to conditions must be exercised as a single decision by one decision-maker; the approval and the fixing of conditions cannot be split between different delegates. The Commission is not limited to approving or rejecting the precise plan submitted and may approve alterations, at least where the result is not substantially different. An incorporated conservation group must demonstrate an interest over and above that of the public at large to obtain certiorari in planning matters; mere intellectual or emotional concern, submission-making, and participation in consultative groups are insufficient.
