Once an appeal against sentence on the merits has been heard and determined under s 668 of the Criminal Code (Qld), the right of appeal is exhausted and no second appeal on the merits is available. Section 8 of the Supreme Court of Queensland Act 1991 does not confer additional criminal appellate jurisdiction beyond that provided by the Criminal Code.
