Notification under s 60(1) of the Telecommunications (Interception) Act 1979 (Cth) may be given to a person acting on behalf of the Managing Director of a carrier; personal notification to the Managing Director is not required. A failure to comply with the administrative duty of notification under s 60(1) after a warrant has been validly issued and activated under s 47 does not affect the validity of the warrant or the admissibility of evidence obtained under it. Lawful eavesdropping through telephone intercepts does not become unfair merely because the investigation has reached a stage where a caution would be required for a direct interview.
