A starting point of 10 years for a s 33 malicious wounding with intent offence involving a single superficial stab wound was held excessive by the majority. The amended s 7(1A) of the Criminal Appeal Act 1912, extending the Court's power to adjust sentences across multiple indictments, does not operate retrospectively. Section 56 of the Crimes (Sentencing Procedure) Act 1999 does not require accumulation where the non-parole period of the prior sentence has expired and the offender is serving only the balance of the term.
