Where an offender pleads guilty early and is sentenced well before co-offenders, the parity principle requires that the early plea be reflected as a mitigating factor in the comparative sentences. A lack of disparity between the sentences of an early-pleading offender and later-pleading co-offenders with more charges can bespeak error. The sentencing judge has discretion under s 89(4)(a) of the Sentencing Act 1991 (Vic) to suspend rather than cancel a driver's licence.
