A ban from premises where an offence is subsequently committed is a relevant aggravating factor in sentencing. Structural arguments comparing sentences on different counts remain discouraged; the proper approach is to assess whether each individual sentence and measure of cumulation is within range, and a comparison between counts will only succeed if the disconformity impugns the instinctive synthesis.
