A depressive condition that does not amount to a mental illness does not require a sentencing judge to substantially reduce the weight given to general and specific deterrence in culpable driving cases. The Anderson and Tsiaras principles concerning mental illness and sentencing are confined to cases of actual mental illness. Licence disqualification periods for culpable driving should take account of the effect on rehabilitation, and a period ending two years after release from custody may be appropriate.
