On a Director's appeal against sentence for culpable driving causing death, even where two of three judges consider the sentence manifestly inadequate, the court may exercise its residual discretion not to intervene where exceptional circumstances exist, including the especially burdensome quality of incarceration for an overseas national imprisoned far from family who entered the jurisdiction for lawful purposes. The combination of hardship from foreign imprisonment, the respondent's expectation of release, and significant rehabilitation prospects may together be sufficient to enliven the discretion, even though no single factor alone would suffice.
