Where co-offenders are sentenced by the same judge for the same offence, differences in culpability, age and prior record that are not particularly substantial will not justify a disparity between immediate imprisonment for one offender and a non-custodial order for the other. A sentencing judge must expressly address all relevant aspects of each co-offender's record, including suspended sentences, when undertaking the comparative evaluation required by the parity principle.
