Where a Medical Assessment Panel's determination is quashed and the matter remitted, the Panel must conduct a fresh medical examination and make its second determination within 28 days of that examination, in accordance with s 145E(2) of the Workers' Compensation and Rehabilitation Act 1981 (WA). Issues of causation remain beyond the Panel's jurisdiction, which is confined to diagnostic questions about the nature and extent of disability and the worker's capacity for work.
