A sentence of 6 years' imprisonment with a 3-year non-parole period for a single count of offering to assist an act of indecency on a person under 16 outside Australia was upheld as within the sentencing discretion, notwithstanding the offender's age (71), lack of prior record, and ill health. The transitional provisions in Schedule 1, item 2 of the Sentencing Legislation Amendment and Repeal Act 2003 (WA) do not apply to sentencing for federal offences.
