Evidence of alternative scientific methodology for voice identification (such as acoustic analysis using Bayes' theorem) is not relevant under s 55 of the Evidence Act 1995 where the expert has not applied that methodology to the facts of the case and cannot offer an opinion on the identity of the speakers. Ad hoc expertise in voice identification remains sufficient for admissibility, with challenges to the basis of familiarity going to weight rather than admissibility. A surveillance log book containing prejudicial material about uncharged criminal conduct should be edited or marked for identification rather than tendered in its entirety, even where tendered for a limited purpose.
