The strength of the Crown case is irrelevant to the utilitarian value of a plea of guilty; it is relevant only to the evaluation of remorse. Where a sentencing judge does not quantify the discount for a guilty plea, the judge must carefully enunciate the factors taken into account and the principles applied. An early plea of guilty in the Local Court, approximately three months after the offence, may warrant a discount of 25%.
