For dangerous driving causing death, a head sentence of 18 months imprisonment is at the bottom of the range. While a custodial term will be imposed in all but rare cases, cases of 'momentary inattention' are among those rare cases that may attract a non-custodial sentence because the claims of deterrence are less compelling. A failure to stop does not necessarily preclude a characterisation of momentary inattention where the driver's vehicle configuration limited rearward visibility.
