A warning statement is not 'attached' to a contract for the sale of residential property 'as its first or top sheet' within s 366(1) of the Property Agents and Motor Dealers Act 2000 (Qld) merely by being transmitted as part of a continuous fax immediately preceding the contract. Physical joinder or incorporation is required. The question of at what point in the dealings the warning statement must be attached — when the buyer receives the draft, when the buyer signs, or when the parties become bound — remains open.
