The appropriate sentencing range for rape involving threats with a weapon, a child victim, and deprivation of liberty is seven to nine years imprisonment. A sentence at the high end of that range (nine years) requires specially serious factors such as the infliction of injury or the use of serious threats with a cutting or deadly instrument; where actual physical violence is limited to the acts of rape themselves and threats are made with a non-deadly weapon (pool cue), the mid-point of the range (eight years) is more appropriate. A very late guilty plea entered after the complainant has been cross-examined twice entitles the offender to only a small reduction in the otherwise appropriate sentence.
