The sentencing range of seven to ten years identified in R v Basic for rape offences applies to cases involving considerable violence inflicted on the victim, not to rape of a stranger without violence as was incorrectly submitted by the prosecutor. For a rape by a stranger involving a relatively harmless weapon, no significant violence, a non-protracted assault, no threats of retribution, and a youthful offender (19 years old), a sentence of eight years imprisonment was appropriate.
