Sentences of 5 months for aggravated burglary and 4 months for intentionally causing serious injury were manifestly inadequate even for a youthful offender with rehabilitation prospects, given the gravity of the offences and extensive criminal history. However, genuine rehabilitation progress between original sentencing and the appeal hearing may justify a wholly suspended sentence on re-sentencing, even for very serious offences. The Director accepted a wholly suspended sentence of 3 years as within range on the Crown appeal.
