The operational period of a partially suspended sentence runs from the date of sentence and includes time spent in custody. Precision is not required in fixing individual sentences on multiple counts, and structural arguments about relative severity of individual sentences are usually without merit. Where a sentencing judge materially misapprehends the factual basis of a count, the sentencing discretion is reopened, but the Court of Appeal may grant leave and dismiss the appeal if no lesser total effective sentence is warranted.
