Where multiple sexual offence counts involving different complainants are joined in one presentment, the trial judge must warn the jury against impermissible propensity reasoning in relation to all counts, not merely in relation to uncharged acts. The jury must be told that a verdict on one count does not dictate the verdict on other counts. Failure to give such directions will occasion a miscarriage of justice, even where the prosecutor did not expressly invoke propensity reasoning.
