A Longman warning must not be diluted by references to police investigative disadvantage or by comments that it is 'not uncommon' for the complainant to be the only witness in sexual offence cases; such references may be interpreted as excusing deficiencies in the Crown case rather than warning of the forensic disadvantage to the accused. For the purposes of s 607 of the Crimes Act 1958, a 'proceeding' commences when a presentment is filed or filed over in the County Court or Supreme Court, not when a charge is filed in the Magistrates' Court under s 26(1) of the Magistrates' Court Act 1989.
