A conspiracy to commit a single continuous offence of obtaining property by deception is capable of being an automatic forfeiture offence under paragraph (c) of Schedule 2 to the Confiscation Act 1997 (Vic), provided the value threshold is met. When determining whether a count is a rolled-up count, the court may examine the entire charge history including original police charges, not merely the presentment. Once a plea of guilty is entered to a count alleging conspiracy to commit a single offence, the sentencing judge is not entitled to recharacterise the count as charging a conspiracy to commit multiple offences.
