A single conspiracy count under s 11.5 of the Criminal Code Act 1995 (Cth) may validly charge an agreement to commit multiple preparatory acts for one or more terrorist acts without being duplicitous, because the Code's conspiracy provisions adopt common law meanings permitting a single conspiracy to encompass multiple offences. The DPP's consent under s 11.5(8) need not be given before the issue of a court attendance notice; it suffices that consent exists before the actual commencement of committal proceedings. A conspiracy to do acts in preparation for a terrorist act under s 101.6 is not an offence unknown to law merely because the agreement could itself constitute a preparatory act.
