A suspended sentence may be imposed for conspiracy to manufacture methylamphetamine where the offender has good antecedents, pleaded guilty early, played a lesser role, and where imprisonment would cause exceptional hardship to dependent children for whom the offender is the sole carer, particularly where psychiatric illness compounds the hardship. The practical effect of the Sentencing Legislation Amendment and Repeal Act 2003 (WA) is that suspended sentences under s 76 of the Sentencing Act 1995 (WA) are now available for sentences equivalent to pre-transitional terms of up to 7 years 6 months.
