A plaintiff's intention not to carry out rectification work does not of itself preclude an award of rectification damages for defective building work. The significance lies in why the plaintiff does or does not intend to carry out the work, for the light it sheds on whether rectification is necessary and reasonable to achieve the contractual objective. Similarly, the sale of the property does not of itself displace the rectification measure, though it is relevant to reasonableness. A builder's statutory obligations to purchasers under the Home Building Act do not negate the plaintiff's compensable loss.
