When applying the Henry guideline for armed robbery or robbery in company, the guideline sentence of four to five years already incorporates a discount for a plea of guilty (albeit a late plea). A further full 25% discount under Thomson and Houlton for an early plea constitutes impermissible double-counting. The statutory ratio under s 44(2) of the Crimes (Sentencing Procedure) Act 1999 is 75% non-parole period to 25% balance of term, not two-thirds to one-third. Where an offender commits multiple offences sequentially, some accumulation of sentences is required; fully concurrent sentences for sequential offending are outside the range legitimately available.
