When sentencing for false imprisonment as a continuing offence during which other charged and uncharged offences were committed, the offending conduct on those other acts may properly be treated as a general circumstance of aggravation of the false imprisonment, provided the sentencing judge carefully identifies the criminal conduct relating to each count and avoids double punishment. Reference to domestic violence murder cases when considering general deterrence for non-fatal domestic violence offences is not erroneous.
