Conditions of deferred commencement consent that require significant redesign of a development without specifying clear criteria for assessment do not comply with s 80A(4) of the EP&A Act and cannot constitute a valid consent to the development application as lodged. The Mison principle that conditions must not significantly alter the development from that described in the application continues to apply alongside s 80A. Where a draft LEP has been placed on public exhibition and contains provisions directly relevant to a development application, the consent authority must engage with the substance of those provisions, not merely defer the question to the applicant.
