Errors by a co-offender's sentencing judge in comparing the number of offences (by inconsistently including or excluding Form 1 matters) and in commenting on whether the applicant should have been charged with more serious offences can give rise to a justifiable sense of grievance warranting appellate intervention, even where the applicant's original sentence was not itself excessive. A sentencing judge should not speculate about alternative charges that could have been laid against a co-offender.
