An offender who knowingly allows peer-to-peer file sharing software to distribute child exploitation material through default settings is not necessarily less culpable than one who actively distributes. A head sentence of three and a half years imprisonment is appropriate for distribution of a very large quantity of material in the worst category under s 228C Criminal Code (Qld), with parole eligibility in the range of 14 months where there are mitigating factors including guilty plea and cooperation.
