Posting offensive material on publicly accessible social media tribute pages for deceased children, while warranting custodial sentences for general deterrence, does not fall within the worst category of offences under s 474.17(1) Criminal Code (Cth) so as to justify the maximum penalty of 3 years imprisonment. Child exploitation material offences involving manipulated or morphed images of deceased children with sexual imagery superimposed are less serious than offences involving images of actual sexual abuse, because the former do not involve the sexual exploitation, corruption and moral degradation of children which defines the seriousness of conduct under ss 228C and 228D Criminal Code (Qld).
