There is no 'principle of restraint' applicable when the Court of Criminal Appeal determines a Detention Application under s 50 of the Bail Act 2013 following a grant of bail by a single Supreme Court judge. The CCA exercises original jurisdiction and determines applications de novo under s 68. The historical cases from the Court of Appeal concerning restraint in reviewing District Court bail decisions are of historical interest only and do not apply under the current Act. The 'double jeopardy' principle from Crown sentence appeals, abolished by s 68A of the Crimes (Appeal and Review) Act 2001, has no application to detention applications.
