A significant physical disability that makes imprisonment more onerous is a relevant mitigating factor in sentencing for child exploitation material offences, and may justify earlier suspension of a sentence, but does not necessarily require that a sentence be suspended immediately where the sentencing judge has given adequate weight to the disability. Deterrence and denunciation remain important sentencing principles for child exploitation material offences.
