Courts give very significant discounts to sex offenders who plead guilty and save the complainant from giving evidence at committal and trial, usually in the range of one-quarter to one-third of the head sentence applicable after a trial. A deliberate, legally-advised abandonment of an appeal will be set aside where the applicant demonstrates it would be a miscarriage of justice not to allow the application, including where the legal advice was objectively incorrect and the resulting excess imprisonment is substantial (here, approximately 18 months).
