An adverse finding as to a claimant's credibility in a serious injury application under s 134AB of the Accident Compensation Act 1985 (Vic) does not, by itself, justify rejection of all medical opinions supporting the claim; the court must analyse whether objective evidence sustains the medical opinions. Video surveillance depicting a claimant engaging in normal daily activities is not necessarily inconsistent with a claim of severe psychiatric illness, particularly where the claimant's overwhelming symptoms are psychiatric rather than physical. The granting of leave to commence proceedings creates an issue estoppel only as to the existence of a serious injury, not its cause.
