The prohibition on double punishment under s 51(1) of the Interpretation of Legislation Act 1984 and at common law does not prevent conviction for multiple offences arising from a single act where different victims are harmed. Duplicity in a presentment can be cured by the prosecutor's election at the plea hearing. A sentencing judge is entitled to find no genuine remorse notwithstanding a guilty plea where expert evidence establishes that the offender minimised and denied aspects of offending and displayed limited capacity for empathy.
