Parity in sentencing is not a concept available to the prosecution; a sentencing judge cannot be expected to impose a heavier sentence merely because another judge imposed a particular sentence in a related or comparable case. When sentencing for conspiracy, the offender's position in the organisational hierarchy is a significant factor, but the conspiracy charge does not necessarily elevate the seriousness of offences committed by low-level participants. State sentencing statistics may be used as a yardstick for Commonwealth offences where Commonwealth statistics are too sparse.
