An extension of time to appeal of almost one year will not be granted where the explanation for delay is scrappy and unconvincing, the respondent is prejudiced, and the proposed appeal lacks merit. Evidence that could have been obtained with reasonable diligence before the hearing below will not be admitted as fresh evidence on appeal.
