The new provisions of s 35 of the Crimes Act 1900 enacted by the Crimes Amendment Act 2007 are new offences, not amendments to the former s 35, and accordingly the standard non-parole periods under the new provisions do not apply to offences committed under the former s 35. A sentencing error that does not materially affect the sentence imposed will not warrant appellate intervention where the sentence is otherwise within the reasonable range.
