The parity principle applies to bring about a just result in sentences imposed upon persons engaged in the same criminal enterprise regardless of the charges laid, but the further one moves from the position of strict co-offenders, the more diluted the principle becomes. Courts and prosecutorial bodies should take active steps to ensure related offenders are sentenced by the same judge at the same time. R v Hoole is no longer persuasive on the question of parity comparisons where offenders are sentenced for overlapping but not identical offences.
