Where an applicant has abandoned a criminal appeal and seeks an extension of time without offering any explanation for the abandonment or delay, the application will be refused unless the applicant can demonstrate injustice in the conduct of the trial, the directions of the judge, or the verdicts returned by the jury. Verdicts of guilty on one count of rape and not guilty on another count of rape are not necessarily inconsistent where the jury may have had a reasonable doubt about dates relevant to the second count.
