The cost and inconvenience of complying with case management orders (filing defences, engaging in discovery) pending an appeal does not constitute special circumstances justifying a stay. The mere possibility that third parties might be joined is insufficient. Where an appeal will not be rendered nugatory by refusal of a stay, and the applicant's complaint is limited to the expense of compliance with interlocutory orders, a stay will be refused.
